Penitentiary law is an independent branch of Russian law, which enters a complex of branches of the criminal cycle along with criminal law and criminal procedure law. It fixes the basic provisions of State penal execution policy in its institutes and norms. Independence of penitentiary law is determined by the existence of own subject of legal regulation and its corresponding method of legal regulation, as well as the system of norms fixing the purposes, principles, directions, main forms and methods for the implementation of State penal execution policy.
Subject of Russian penitentiary law includes: general provisions and principles of the execution of penal sanctions; application of other penal measures provided by the Criminal Code; application of correctional measures to convicts; penalty execution order and conditions; procedure of the activities of penal execution bodies and institutions; procedure for the participation of specialized executive authorities, other organizations or establishments, public associations and citizens in reformation of convicts; procedure for the exemption of convicts from punishment; procedure for the assistance to the exempted persons.
Imperative method is the main method regulating the process of punishment execution and application of correctional influence. This is because that criminal penalty represents the strictest form of State compulsion, and the imperative method implies inequality of the subjects of legal relations and is based on the application of authoritative legal instructions. Subjects of legal relations can perform only the actions permitted thereby. In this case, the main means of influence to the relations involve prohibitions, obligations, penalties and other legal restrictions. Imperative method is a main method of legal regulation of relations in the application of both penitentiary, and penal and criminal procedural norms.
The presence of the special subject of legal regulation causes the existence of normative base. This is another confirmation of the independence of the considered legal branch. Independence of the subject of legal regulation, the presence of its system of norms allows to deal with uniform orientation of penitentiary norms to achieve the goals of punishment. This is due to the internal consistency of specific principles and general provisions, which are the base for law-making and law-enforcement activities in the sphere of punishment execution, as well as for the special impact on the subject in the form of relations occurring in connection with punishment execution and reformation of convicts. This circumstance indicates the presence of a specific legal regime, determining the regulation (with assistance of legal norms) of relations that arise with respect to the execution of penal sanctions.
The system of Russian penitentiary law norms consists of the Penal Execution Code and other normative regulations.
Russian Penitentiary has specific principles, which fleshed out and detailed in the norms of the General and Special parts of the Penal Execution Code. So, the penal execution legislation of the Russian Federation regulates the following principles of penitentiary law: legality, humanism, democracy, equality of convicts before the law, differentiation of punishment execution, individualization of punishment execution, rational use of compulsory measures, rational use of correctional measures, stimulation of law-abiding behavior. These principles define the construction and contents of the Special part of the Penal Execution Code, affect the contents of the institutions and norms of this Code, provide guidance for other legislative and sub-legislative acts governing the execution of various punishment types, affect the penal execution practice through its correction in favor of implementing progressive ideas of legality, humanism, equality of citizens before the law.
