In the Russian Federation Criminal law is the main tool in the fight against crimes. Its provisions have a direct relevance to the protection of human rights and freedoms of citizens, interests of society and the State, as well as to the criminal liability issues.
Russian Criminal law has the special subject and method of legal regulation, and objectives. The subject of legal regulation includes such relations, which arise between the offender and the State only after committing a crime. Any other legal branch cannot regulate these relations. Contents of relations included into the subject of legal regulation are specific and difficult.
Prohibition, permission and instruction are the basic types of the method of legal regulation. Method of legal prohibition is the most typical for the criminal law. It appears in forbidding socially dangerous acts, gravity of legal results for the person, who has violated a legal prohibition.
Objectives of Russian criminal law determine the objects and priorities of penal protection. The objects of penal protection include human rights and freedoms of citizens, ownership, public order and public security, environment, the constitutional system of the Russian Federation.
It is necessary to emphasize that these objects of penal protection are protected both by criminal legislation, and other legal means. The most important role belongs to the criminal law. The objectives of criminal law are formed by proceeding from social and economic problems, which were solved by society and government at different stages of its development. They are connected with condition of criminal situation and security of legality in the country.
Criminal statute is an exclusive source of Russian criminal law. Unlike other legal branches, the legal norms defining criminality and punishability of deeds should be expressed only in the form of legislative act. It is conditioned by high degree of social danger of crimes in comparison with other types of offences. Punishments provided for the commitment of crimes contain the most serious legal consequences in comparison with other types of responsibility.
Current criminal legislation of the Russian Federation is completely codified. The Criminal Code is an exclusive criminal statute of the Russian Federation. The Criminal Code is a systematised sectoral normative act, which consistently associates with current penal norms, defines the criminality and punishability of deeds, establishes the grounds and limits of criminal liability, the grounds for exemption from criminal liability and punishment. The current Criminal Code of the Russian Federation was approved by the Federal Law of May 24, 1996, came into force in January 1, 1997.
