It is noted in the paper that there is a close interrelation between conviction and punishment. The social danger of a person found guilty of committing a crime is necessary condition for inseparable connection between punishment and conviction. According to the author, the social danger of the person, who commits a crime after serving a punishment imposed by the court, is high. Based on this, the author suggests that the definition of crime recidivism shall be fixed as commitment of crime by a person, who was completely or partially served his/her punishment for the previously committed crime. It is considered as only correct definition of the crime recidivism.
