The considered paper speaks on guilt in penal meaning. The author states that the main categories characterizing the guilt include its contents, form and degree. The penal contents of guilt lie in the fact that, while being reflected in the criminal law, guilt gets value of a sign of the crime subjective aspect, expressed in a certain form of guilt. Intention or negligence get the penal significance only in cases, when an act recognized as a crime is committed. According to the author, the form of guilt is a certain relationship of intellectual and volitional components fixed by the criminal law, which characterizes a certain attitude of a crime committer to the socially dangerous act and penal consequences. The degree of guilt is an evaluation category, which contains psychological and social characteristics of guilt from its quantitative aspect, and expresses the negative, neglect or insufficiently attentive relation of the offender to objective circumstances of crime.
